The Government is proposing amendments to the Law on the Structure of the Black Sea Coast
Sofia. The Council of Ministers approved a Draft law on amendment to the Law on the Structure of the Black Sea Coast (DLA of LSBSC) and proposed to the National Assembly (the Parliament) to consider and adopt the project.
The draft law provides for amendments to the administrative and penal provisions of the LSBSC. Administrative penalties are determined in accordance with an assessment of the degree of harm to the public interest in breach of the relevant provision of the law.
Sanctions are foreseen to place a moveable object on an unguarded beach in violation of the law. To leave beach accessories and passing or stopping a vehicle on mobile (white) dunes, fixed dunes with herbaceous vegetation (gray dunes) and Wooded dunes. Also included are sanctions for beach operators if they do not provide equivalent access for visitors to have free beach umbrellas.
The rules also concern the bodies involved in the administrative procedure in establishing violations and defining penalties. It is envisaged to refer to the rules for the implementation of the administrative penal procedure in the respective law, in cases where an area of regulation is in the competence of another administrative body.
