PUBLISHER AGREEMENT – TransferBulgaria affiliate program

The Terms and Conditions stated below apply for every publisher taking part in the TransferBulgaria affiliate and partner programmes.

Registering with TransferBulgaria programme confirms that you have read and understood our agreement and by clicking on the "Register" button, you are accepting the conditions of said agreement. Obligations of the Publisher

1. The publisher is solely responsible for their website and its contents and shall ensure that at all times they conform to any applicable laws and regulations.

2. If the publisher is a natural person, they must be at least 18 years of age. If the publisher has not reached the age of 18 a parent must give consent for registration with the TB Affiliate Programme’s service.

Registration of a publisher below the age of 18 and without parental consent will be ineffective.

3. The publisher warrants that all information provided to TransferBulgaria about themselves and any website is correct, complete and sent in due order and that the information corresponds to actual facts. The publisher must notify TB immediately of any changes of information by updating this on the TB Network Programme website.

4. The publisher warrants either that the rights to all information and productions on the publishers website belong to the publisher or that the owner of the rights to the information and productions on the publishers website has given their explicit permission to the publication. The publisher also warrants that the information and productions on the publishers website do not infringe any rights of third parties, including intellectual property rights, and that such information and productions are not offensive, prohibited or questionable in any way.

5. The publisher must notify TB immediately of any known, suspected improper or wrongful use of the publishers links to any TB website and/or TB Private Network Program.

6. Type of Websites Websites with illegal, violent or erotic content are excluded from the participation of the TB affiliate programme.

TB reserves the right, at any stage, to exclude affiliates with the following websites:

• Sites with their own affiliate programme
• Sites that are under construction
• Sites which are not accessible or have above average loading times
• Sites that forward traffic to other sites with pornographic or violent content
• Sites whose main content is gambling
• Sites that offer free internet services
• Sites which offer the exchange of banners
• Sites with paid / forced clicks

7. Voucher or Loyalty Sites TB do not currently offer voucher codes. However, voucher and loyalty sites are allowed to communicate discounts and promotional offers, but under no circumstances are these allowed to offer vouchers which have not been released for affiliate use.

8. Intellectual Property Rights All advertising material is the intellectual property of TB and can only be used by affiliates as part of the TransferBulgaria affiliate programme. TB has the right to withdraw their consent for the use of all intellectual properties, including affiliate links, at any time. The name TransferBulgaria or any combination of their brand terms are not allowed to be used in meta tags, etc. Non compliance of these terms and conditions may result in a suspension from the affiliate program

9. Keyword Bidding Policy In order to protect TransferBulgaria Intellectual Property Rights, affiliates are not allowed to bid on the TB brand trademark nor use its brand trademarks in the following circumstances:

• Destination URL, keyword, heading or ad text
• Use misspellings of the word TransferBulgaria or any related brand terms
• Use of misleading descriptions

10.Direct linking to any of the TB domains is forbidden.

11. Layer/ Post View Cooperation

The generation of cookies is only allowed in the following circumstances:

• Click is generated by the user when the ad material is clearly visible
• Click is generated by the user voluntarily and consciously
• Strictly prohibited is the invisible integration of the TB online shop to generate a cookie for the user. In general TB partners are not allowed to use iFrames, Pop-under and layer ads, which produces a cookie without the user noticing.
• Post view tracking is not allowed unless agreed with TB in writing. Should a written agreement be given by TB, only one cookie is allowed to be dropped per view.

12. Bookings Bookings done for personal use will not be validated and therefore no commission will be paid accordingly.

13. Domains Using misspellings of the word TransferBulgaria in the domain is not allowed neither is direct linking to the Sixt domain.

14. Advertising Material All ad material made available by TB is to be used for approved URL’s only. Should further URL’s be added to the account at a later stage, the affiliate has to contact us for approval of the new URL. Misuse or manipulation of the advertising material may lead to the exclusion of the TB affiliate programme. Any further misuse, specifically the distribution or duplication of advertising material for commercial purposes, is strictly prohibited unless agreed to by TB. This is also valid for the admission into electronic data bases and duplication on CD-ROM, DVD etc. In all other respects there are legal constraints in respect of copyrights, data protection and other applicable regulations. Judicial requirements, which can be derived from it, are passed on in the full extent to the affiliate. TB has the right to withdraw any affiliate partnership or withhold commissions, should the affiliate breach any of the terms and conditions. Furthermore, TB reserves the right to take legal action should it feel the need. Should you have any further questions, please do not hesitate to contact us.
